1. Introduction and Acceptance of Terms

Welcome to Honest Dating.

Honest Dating (“HD,” “we,” “us,” or “our”) is a dating and social connection platform designed to help people overcome loneliness through meaningful human connections.

These Terms of Service (“Terms”) govern your access to and use of the Honest Dating website, mobile applications, and associated products, features, content, and services (collectively, the “Service”).

By creating an account, accepting these Terms, or using the Service, you enter into a legally binding agreement with the operating entity identified above.

If you do not agree to these Terms, you must not register for or use Honest Dating.

Your use of the Service is also subject to our Privacy Policy, Acceptable Use Policy, and other applicable policies expressly incorporated into these Terms.

Where applicable law provides mandatory consumer rights, nothing in these Terms excludes or limits those rights.

2. Eligibility

Honest Dating is exclusively intended for adults. To register and use the Service, you must:

Be at least 18 years old.
Have the legal capacity to enter into a binding agreement.
Provide accurate and truthful registration information.
Complete our mandatory registration and verification requirements.
Not be prohibited from using the Service under applicable law.
Not be subject to an active suspension or permanent ban imposed by Honest Dating.
Use the Service for genuine, lawful personal and social connection purposes.

By registering, you represent that you meet these requirements.

We may refuse, restrict, suspend, or terminate access where we reasonably determine that an account does not satisfy our eligibility or safety requirements.

We may request additional information or verification when reasonably necessary to establish eligibility, investigate suspected abuse, or comply with legal obligations.

3. Account Registration and Human Verification

3.1 Account Creation

Honest Dating supports account creation and authentication through approved third-party authentication providers, including Apple and Google.

You are responsible for maintaining the security of your authentication credentials and associated accounts. You must not transfer, sell, share, or otherwise permit another person to operate your Honest Dating account.

3.2 Human Verification

Honest Dating requires members to complete a 3D liveness verification process during registration. This process is intended to help establish that a real person is present and to reduce automated accounts, impersonation, and fraudulent profiles.

Your main profile photograph must also successfully complete our face-consistency verification process.

Human verification does not constitute legal identity verification. Honest Dating does not represent that it has independently verified a member's legal name, government-issued identity, background, or actual age through government identification.

You acknowledge that verification reduces certain risks but cannot eliminate impersonation, misrepresentation, or other misconduct.

3.3 Protected Registration Information

Certain registration information, including your first name, gender, and date of birth, is protected against unrestricted editing after registration. Corrections may require contacting our support team and completing additional verification.

You agree not to provide false information or attempt to circumvent these protections.

3.4 Duplicate and Fraudulent Accounts

We may use appropriate technical and administrative measures to identify potentially duplicate, fraudulent, or unauthorized accounts.

Creating additional accounts to evade restrictions, impersonate others, manipulate the Service, or circumvent enforcement decisions is prohibited.

4. Nature and Purpose of the Service

Honest Dating facilitates opportunities for romantic relationships, friendships, shared activities, and meaningful social interactions.

The Service includes, where available:

Profile creation and discovery.
Romantic Likes and mutual Matches.
Friendship Offers and accepted Friendships.
Private messaging between established connections.
Mutually enabled voice and video communication.
Target Me, our intentional audience-targeted conversation feature.
Profile interests, preferences, and optional profile-depth features.
Member-controlled discovery and account settings.

Features may change as the Service develops.

We do not guarantee that using Honest Dating will result in a Match, Friendship, conversation, date, relationship, or any other particular outcome.

Honest Dating is a technology platform facilitating connections between members. We are not a matchmaking agency guaranteeing personal compatibility, relationship success, or the conduct of other members.

5. Our Connection Model

Honest Dating provides two distinct connection paths: Romance and Friendship.

5.1 Romance

Members may express romantic interest by sending a Like accompanied by a personal explanation. The explanation remains private until romantic interest becomes mutual.

A Match is established only when both members independently express romantic interest. Upon matching, both explanations become visible and private messaging becomes available.

5.2 Friendship

Members may send Friendship Offers accompanied by a personal explanation. Unlike romantic Like explanations, Friendship Offer explanations are immediately visible to recipients.

A Friendship is established only when the recipient accepts the offer. Sending an offer does not entitle the sender to acceptance, a response, or further interaction.

5.3 Member Autonomy

Every member has the right to decide whether, when, and how to interact with another member. No member is obligated to:

Return a Like.
Accept a Friendship Offer.
Respond to messages.
Continue a conversation.
Participate in a call.
Share personal contact information.
Meet another member in person.
Continue an established connection.

Members must respect these decisions. Persistent unwanted contact, coercion, retaliation, and attempts to circumvent another member's boundaries are prohibited.

5.4 Ending Connections

Members may end applicable connections through the controls provided by the Service.

Unmatching and blocking are distinct actions and may have different consequences.

Ending a connection does not necessarily delete all associated information immediately. Relevant records may be retained as described in our Privacy Policy, including where necessary for safety, legal compliance, dispute resolution, or legitimate operational purposes.

6. Target Me

Target Me allows eligible members to initiate temporary, text-based conversations with a deliberately selected audience.

Members may select an audience using supported criteria, subject to applicable privacy, eligibility, targeting, and safety restrictions.

Target Me posts may support public discussions, private replies, and eligible identity-display options, including Incognito.

6.1 Responsible Targeting

You must not use Target Me to:

Harass, intimidate, or exploit a person or group.
Facilitate discriminatory abuse.
Target individuals for fraud or manipulation.
Solicit prohibited activities.
Circumvent another member's privacy settings or boundaries.
Collect personal information for unauthorized purposes.
Distribute spam or unsolicited commercial content.

The availability of an audience-selection criterion does not automatically make every use of that criterion acceptable.

6.2 Content Moderation

Target Me submissions are subject to automated review before publication.

Moderation may evaluate the content, selected audience, and relevant context together.

Depending on the outcome, a submission may be approved, rejected, or referred for additional human review.

We may remove, restrict, or close Target Me conversations that violate these Terms or applicable policies.

6.3 Incognito

Where Incognito is available, it provides a limited identity-display option within the applicable feature.

Incognito does not make a member anonymous to Honest Dating, exempt them from moderation, or prevent legally required disclosures.

7. Acceptable Use and Member Conduct

You agree to use Honest Dating respectfully, lawfully, and in accordance with its intended purpose. You must comply with our separately published Acceptable Use Policy (AUP), which forms part of these Terms.

Prohibited conduct includes, without limitation:

Creating fake, misleading, or impersonation-based profiles.
Harassment, bullying, threats, stalking, or intimidation.
Hate speech or abusive discriminatory conduct.
Sexual exploitation, coercion, or non-consensual sexual content.
Any activity involving the sexual exploitation or abuse of minors.
Fraud, financial scams, extortion, or deceptive solicitation.
Unsolicited advertising, spam, or commercial recruitment.
Unauthorized collection or distribution of personal information.
Uploading content that infringes another person's rights.
Using bots, scraping tools, automated account systems, or unauthorized software.
Circumventing verification, moderation, security, or access restrictions.
Encouraging or facilitating illegal activity.
Misusing another member's photographs, messages, or personal information.

You must not use Honest Dating as a marketplace for prohibited goods or services, financial solicitation, or unlawful transactions.

We may investigate suspected violations and take proportionate enforcement action.

8. Member Content

8.1 Ownership

You retain ownership of the content you lawfully submit to Honest Dating, including profile photographs, written descriptions, interests, answers, messages, and Target Me posts (“Member Content”).

You are responsible for ensuring that you have the necessary rights to submit that content.

8.2 License to Honest Dating

By submitting Member Content, you grant Honest Dating a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, display, transmit, and otherwise use that content solely as reasonably necessary to:

Operate and provide the Service.
Display your content according to applicable feature functionality and privacy settings.
Facilitate member interactions.
Maintain security and platform integrity.
Perform authorized moderation.
Comply with applicable legal obligations.

This license lasts for as long as reasonably necessary for those purposes, subject to applicable law and our Privacy Policy. We do not acquire ownership of your Member Content.

This license does not authorize unrelated commercial advertising using your identity or photographs without an appropriate additional legal basis or permission.

8.3 Content Visibility

You acknowledge that content visibility depends on the relevant feature. For example:

Profile information may be visible to eligible members.
Like explanations remain private until mutual romantic interest is established.
Friendship Offer explanations are visible to recipients.
Public Target Me discussions are visible to their applicable audiences.
Private communications are accessible to their intended participants, subject to applicable safety, moderation, and legal processes.

You should not assume that information shared with another member will remain confidential after that member receives it.

Other members may capture, retain, or disclose information contrary to our policies despite our protective measures.

8.4 Content Removal

We may remove or restrict Member Content where reasonably necessary to enforce these Terms, protect members, comply with law, or maintain the integrity of the Service.

9. Privacy and Biometric Information

Your privacy is important to Honest Dating. Our collection, use, disclosure, retention, and protection of personal information are described in our separately published Privacy Policy.

Registration may involve biometric processing through our verification provider, FaceTec. Biometric information is used for applicable human-verification, face-consistency, and account-integrity purposes, as further described in our Privacy Policy and Biometric Data & Verification Notice.

Where required by applicable law, we will provide additional notices and obtain the necessary consent or establish another valid legal basis before processing relevant information.

Your acceptance of these Terms does not replace any separate consent legally required for biometric processing or other specific processing activities.

You must not attempt to obtain, extract, reconstruct, or misuse another member's biometric or personal information.

10. Membership, Pricing, and Payments

10.1 Fair Membership

Honest Dating operates on a principle of equal access.

Under our standard membership model, members receive an introductory free month without being required to provide a credit card.

After the applicable introductory period, members may select one of ten monthly membership prices, ranging from USD $1 to USD $10, based on their perceived value of the Service.

All available price selections provide the same membership access.

Paying a higher amount does not provide preferential visibility, additional romantic opportunities, premium status, or advantages over members selecting a lower amount.

10.2 Initial Free-Access Period

Honest Dating may offer an extended free-access period during its initial launch and community-building phase. The duration of this period is determined by Honest Dating and is not tied to a guaranteed number of registrations or a predetermined end date.

Honest Dating reserves the right to determine when the initial free-access period concludes.

Members will be notified in advance of the transition to the standard Your Fairness membership model. No member will be charged automatically as a result of this transition. Members must explicitly authorize their paid membership before any payment is collected.

10.3 Your Fairness — Monthly Membership Contributions

Honest Dating operates on a retrospective, member-selected pricing model called Your Fairness.

Under this model, members experience the Service first and determine the value of their experience at the end of each monthly membership period.

The following principles apply:

The first month of standard membership is free.
At the end of every subsequent month, members choose one of ten available contribution amounts, ranging from USD $1 to USD $10.
Members make a new pricing decision every month, based on their experience during that particular month.
A member's previous contribution does not determine or restrict their contribution for any subsequent month.
Every contribution amount provides exactly the same access to Honest Dating.
Higher contributions do not provide additional features, preferential visibility, increased exposure, or any other membership advantage.

For example, a member may value one month's experience at $1 and the following month's experience at $5. There is no predetermined correct contribution. Members are encouraged to make their selections honestly and fairly.

Payment is processed following the member's monthly price selection, in accordance with the payment authorization and billing conditions disclosed to the member.

Applicable cancellation, non-selection, failed-payment, and refund procedures are described in our Membership, Billing & Refund Policy.

10.4 Payment Processing

Payments may be processed through Stripe or another authorized payment provider.

Payment information is handled according to the applicable provider's terms and our Privacy Policy.

You agree to provide accurate payment information and maintain a valid payment method while your paid subscription remains active.

10.5 Cancellation

Members may cancel their paid subscriptions through the available membership-management process.

Cancellation prevents subsequent recurring charges, subject to applicable processing cutoffs and mandatory law.

Unless otherwise required by law or expressly disclosed in the applicable offer, cancellation does not automatically create a refund for a membership period already charged.

10.6 Refunds

Refund eligibility, billing corrections, and applicable statutory withdrawal or cancellation rights are governed by our Membership, Billing & Refund Policy and mandatory consumer-protection law.

Nothing in these Terms removes rights that cannot lawfully be waived.

10.7 Taxes and Currency

Applicable taxes, currency conversion, and any additional legally required charges will be disclosed before payment confirmation.

11. Safety and Real-World Interactions

Honest Dating is designed to encourage meaningful human connections, including opportunities to meet in person. However, interactions with other members involve inherent risks.

We do not independently guarantee another member's intentions, background, behavior, personal circumstances, or safety. Members are responsible for exercising reasonable judgment when interacting online or meeting in person.

We strongly encourage members to:

Protect sensitive personal and financial information.
Avoid sending money to people they meet through the Service.
Exercise caution when sharing contact details.
Arrange initial meetings in appropriate public locations.
Inform someone they trust about meeting arrangements.
Respect personal boundaries and consent.
Report suspicious or abusive behavior.

Human verification and other safety measures do not constitute a guarantee that a member is trustworthy or that an interaction will be safe.

Honest Dating is not an emergency response service. If you are in immediate danger, contact the appropriate local emergency services.

12. Reporting, Moderation, and Enforcement

Members may report suspected misconduct through available reporting tools or by contacting Honest Dating.

We may review reports, relevant content, account information, technical signals, and other appropriate evidence to investigate potential violations.

Subject to applicable law, enforcement measures may include:

Content rejection or removal.
Warnings.
Restrictions on particular features.
Additional verification requirements.
Temporary account suspension.
Permanent account termination.
Measures intended to prevent repeated abuse.
Referral to appropriate authorities where legally required or justified.

We may use automated systems and human review to support moderation and safety decisions.

Where required by applicable law, we will provide appropriate explanations and opportunities to challenge relevant decisions.

We are not obligated to disclose confidential investigative methods, another member's personal information, or information whose disclosure would compromise safety or security.

13. Intellectual Property

The Honest Dating name, branding, logos, interface designs, software, original content, and associated intellectual property are owned by Honest Dating or its respective licensors.

Except as expressly permitted by these Terms, you may not copy, reproduce, distribute, modify, reverse-engineer, commercially exploit, or create derivative works from the Service without prior written authorization.

These Terms grant you a limited, personal, non-exclusive, non-transferable, revocable right to access and use the Service in accordance with its intended purpose. This right does not transfer ownership of any intellectual property.

14. Third-Party Services

Honest Dating may integrate third-party services for authentication, verification, payment processing, infrastructure, communications, and other operational purposes. Certain integrations may be governed by additional third-party terms or privacy notices.

We are not responsible for independent third-party services beyond the extent required by applicable law.

The use of third-party providers does not remove our own legal obligations concerning the Service.

15. Availability and Changes to the Service

We aim to provide a reliable and consistent experience. However, the Service may occasionally be unavailable due to maintenance, technical problems, security incidents, third-party failures, or circumstances outside our reasonable control.

We may introduce, modify, suspend, or discontinue features for legitimate operational, technical, safety, legal, or product-development reasons. Where changes materially affect an existing paid membership or a member's contractual rights, we will provide notice and applicable remedies as required by law.

We do not guarantee uninterrupted availability or that every feature will remain permanently unchanged.

16. Account Suspension, Termination, and Deletion

You may request account deletion through the available account-management process or by contacting support.

We may suspend or terminate accounts where there are reasonable grounds relating to:

Violations of these Terms or incorporated policies.
Fraud or impersonation.
Serious or repeated misconduct.
Account-security risks.
Legal or regulatory requirements.
Attempts to circumvent previous enforcement measures.

Where appropriate and legally required, we will provide notice and an opportunity to challenge an enforcement decision.

Termination generally ends your right to access the Service.

Account termination and subscription cancellation may involve separate processes. Any outstanding payment obligations and applicable consumer rights remain governed by law and the relevant billing terms.

Following deletion or termination, we will handle personal information according to our Privacy Policy, including applicable retention obligations.

17. Disclaimers

Honest Dating provides tools that enable members to discover and communicate with one another.

We do not promise or guarantee:

A particular number of available members.
Compatibility between members.
Responses to Likes, Friendship Offers, or messages.
Successful dates, friendships, or relationships.
The accuracy of every statement made by another member.
That verification or moderation will identify every instance of misconduct.
That all interactions will be free from risk.

To the extent permitted by applicable law, the Service is provided on an “as available” basis.

Nothing in this section excludes statutory warranties, guarantees, or consumer protections that cannot lawfully be excluded.

18. Limitation of Liability

To the maximum extent permitted by applicable law, Honest Dating is not liable for losses arising solely from the independent acts or omissions of other members or third parties where such losses are not legally attributable to Honest Dating.

We are not responsible for guaranteeing the outcome of personal relationships or interactions facilitated through the Service.

Nothing in these Terms excludes or limits liability for:

Fraud or fraudulent misrepresentation.
Intentional misconduct.
Death or personal injury where liability cannot legally be excluded.
Breaches of mandatory data-protection obligations.
Any other liability that cannot lawfully be excluded or restricted.

Any applicable contractual limitation of liability must be interpreted consistently with mandatory consumer-protection law.

19. Compliance with Law and Law Enforcement Requests

Honest Dating may preserve, review, or disclose relevant information where required or otherwise permitted by applicable law.

Requests from law enforcement and other competent authorities are handled according to our separately published Law Enforcement Guidelines & Request Protocol.

We assess requests for appropriate legal authority, scope, necessity, and applicable jurisdictional requirements.

We do not provide unrestricted access to member information merely because a third party requests it.

Emergency disclosures may be considered where permitted by law and justified by an imminent risk of death or serious physical harm.

20. Changes to These Terms

We may update these Terms to reflect changes in the Service, applicable law, security requirements, or operational practices.

The current version will be published through our website or Service, together with its effective date.

Where required by law, we will provide advance notice of material changes and obtain renewed acceptance or consent where necessary.

Changes will not retroactively remove accrued statutory rights.

If you do not agree to updated Terms, you may discontinue using the Service and exercise applicable account-termination rights.

21. Governing Law and Dispute Resolution

These Terms are governed by and interpreted in accordance with the laws of the Republic of Slovenia.

This choice of law does not deprive consumers of any mandatory protections afforded to them under the laws of their country of habitual residence, where applicable.

Before initiating formal legal proceedings, members are encouraged to contact Honest Dating at info@honestdating.co so that we may attempt to resolve the matter amicably.

Nothing in these Terms limits a consumer's right to bring proceedings before a competent court or exercise any other rights available under applicable consumer-protection law.

22. General Provisions

Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue to apply to the extent legally permissible.

No Waiver. Failure to enforce a provision does not constitute a permanent waiver of that provision.

Assignment. Members may not transfer their accounts or contractual rights without authorization. Honest Dating may transfer its contractual rights and obligations where legally permitted, subject to applicable notice and consumer-protection requirements.

Entire Agreement. These Terms, together with the policies expressly incorporated into them and any applicable membership-specific conditions, constitute the agreement governing your use of the Service.

Language. Where these Terms are translated, any rules concerning interpretation between language versions will be subject to applicable local law.
